One June 15, 2023, the United States House of Representatives passed the Separation of Powers Restoration Act. This bill, which passed by a vote of 220 to 211, would amend the scope of judicial review of agency actions to authorize courts reviewing agency actions to decide “de novo” (which means without giving deference to the agency’s interpretation) all relevant questions of law.
